A lawyer representing the prosecution in a case in which some army members are accused of multiple counts of attempted murder which resulted from the 2014 bombings, Advocate Shaun Abrahams says an application for recusal, which has been filed by one of the accused in the matter, Tlali Kamoli, is a strategy devised to delay commencement and continuation of the trial.

This Abrahams said yesterday when addressing the court in the application whereby the applicant is seeking judge Justice Charles Hungwe to recuse himself from the case. The lawyer representing the applicant, Adv. Letuka Molati said, the applicant is scared that he will not receive a fair trial since the judge has shown some elements of biasness.

The application comes after the judge ruled that the case would proceed in the absence of his lawyer, if he is not in court on set dates.

The court is expected to deliver its ruling on the application on the 4th of next month.
