The high Court has cancelled bail application of Rankakata Moiloa and Matanya Moiloa from Mokhotlong, after they were convicted by the same court on two counts of murder and assault.

The high Court has cancelled bail application of Rankakata Moiloa and Matanya Moiloa from Mokhotlong, after they were convicted by the same court on two counts of murder and assault. 

The duo was found guilty for assaulting and killing Teke Chere Letsapo and Realeboha Letsapo at Pae-La-Itlhatsoa in Mokhotlong on the 11th of February, 2013. They were also found guilty of assaulting and inflicting injuries on Tsotang Qofa with the intention to kill him during the same incident. 

When handing down judgment, Justice Mabatšoeneng Hlaele stated that the prosecution has discharged its onus to prove its case beyond reasonable doubt. However, indicated that evidence from the defence did not hold water as they acted in common purpose in killing the deceased and injuring the victim. 

She indicated that during this incident, Rankakata had a lethal weapon in his possession, adding that he was seen assaulting the deceased and the victim. She emphasised that his actions were contradictory to those he said he was preventing.  

Meanwhile, the High court is yet to be addressed on extenuation and mitigation following which there will be sentencing of the accused. The case will proceed on Monday next week.
