Commissioner of Police (COMPOL) Mr. Holomo Molibeli has approached the High Court seeking for review of the decision of the Prime Minister (PM) to retire him.
Molibeli is, in this application asking the court to set aside the decision and declare it irrational and illegal.
Molibeli’s lawyer Advocate Tekane Maqakachane stated that in his letter to the King dated January 10, 2020, the PM said the applicant had retired as COMPOL while that was not a case. He indicated in the same letter that the PM advised the King to appoint Assistant Commissioner Janki Hlaahla as COMPOL by 12:00 noon that day, failing which he (PM) would act in terms of Section 91 (3) of the Constitution.
They added that the application cannot succeed because it lacks urgency.
The court was informed that the respondents will argue that the PM acted in terms of the Police Act.
The case is before Judge Molefi Makara.
