Residents of Ha-Tsosane in Maseru have filed an application before the Constitutional Court against the Maseru City Council (MCC) and others regarding a dumping site in that area.

The applicants are asking the court to declare that MCC’s dumping of garbage at Ha Tsosane as a violation or residents’ right to well-being, safety and health. They further ask that the conduct of the MCC be declared unreasonable, unjustified and null and void.

They also ask the court to issue an order evicting MCC from Ha-Tsosane dumping area to use Ts’oeneng or any other alternative dump site and dump pollutants in an environmentally friendly manner. They ask that they be directed to clean-up the Ha Tsosane dumping area and leave the same in an environmentally friendly condition.

The respondents in the matter include Golden Rewards(PTY) ltd, Minister of Health, Minister of Tourism, Environment and Culture, Minister of Local Government and Chieftainship, Minister of Law and Constitutional Affairs and the Attorney General.
